Heard learned counsel for the applicants, learned AGA for the State and perused the record.
This anticipatory bail application has been filed by the applicants Omkar Singh, Daya Ram Singh, Kamendra, Mohit Kumar and Sohit @ Sonu in Case Crime No. 213 of 2020, under sections 147, 323, 504, 506 I.P.C. with respect to applicant nos. 1 and 2 and under sections 147, 323, 504, 506, 354B I.P.C. with respect to applicant nos. 3, 4 and 5 as well as under section 3(2)(va) of the SC/ST Act with respect to all the applicants, P.S.- Seohara, District -Bijnor.
At the very outset, learned AGA pointed out that the anticipatory bail application has been given in respect of offence under SC/ST Act and under section 18 of the SC/ST Act, anticipatory bail application is barred.
Learned counsel for the applicants conceded the arguments of learned AGA In view of the provisions of section SC/ST Act, I find that anticipatory bail applicant is not maintainable, hence rejected.
