Heard learned counsel for the petitioner, learned Standing Counsel for the State and Sri Krishna Kant Singh, learned counsel for respondent no. 3.
Present petition has been filed seeking quashing of the order dated 2/3.3.2021 passed by the Sub Divisional Officer/ Sub Divisional Magistrate, Jalesar, District Etah - respondent no. 2.
Learned Standing Counsel submitted that the petitioner has a statutory remedy by way of filing an appeal before the authority concerned.
In such view of the matter, I am not inclined to entertain the petition.
Accordingly, the writ petition is dismissed on the ground of alternative remedy.
Learned counsel for the petitioner sought to argue the matter on various grounds, however I am not inclined to entertain the same as the petitioner is being relegated to avail the statutory remedy, if so advised.
In case the petitioner files an appeal before the authority concerned within a period of 15 days from today, the authority concerned shall entertain and decide the same expeditiously without raising any objection regarding limitation.
