Heard Sri Pratik Chandra, learned counsel appearing for the petitioner and Sri Vivek Kumar, learned Chief Standing Counsel appearing for the State- respondent.
The only prayer made in the writ petition filed in public interest reads thus:
to issue a writ, order or direction in the nature of mandamus directing the respondent no. 1 to look into the matter and to complete the construction of toilet near Jareeb Chowki Charaha via Jhakarpatti in front of sub-station adjacent to Pioneer Timber Molding Boundary, District Kanpur Nagar within stipulated time.
Learned standing counsel at the outset, on instructions, submits that Public Works Department has declined to grant no objection certificate for construction of toilet for the reason that it obstructs the widening of the road. Further, a toilet for public convenience is already available at the distance of 15-20 metre from the spot.
This fact is not being disputed by learned counsel for the petitioner.
In the circumstances, we have no option but to dismiss the writ petition. Order accordingly.
No cost.
