The petitioner claims to be the owner of the property situated in Re Survey No.29/10 (Old Survey No.385/1) of Erumeli North Village. The petitioner approached the second respondent for rectifying the mistake in the Re Survey. On account of delay in considering the application the petitioner has approached this Court.
2. The learned Government Pleader submits that two persons, by name, Sri.Prasad and Sri.Jose have obtained possession and right over the property in Re Survey No.29/10 and therefore, without taking a decision regarding identity of the property, the petitioner's request cannot be acceded to.
3. Considering the facts and circumstances, there shall be a direction to the second respondent to take a decision in the matter within a period of two months, after affording an opportunity of hearing to the petitioner and also Sri.Prasad and Sri.Jose.
The writ petition is disposed of as above.
