Heard Sri Manoj Kumar Tripathi, learned counsel for the petitioner, Sri Vikas Budhwar, learned Counsel for the respondent no.5, learned Standing Counsel for respondent no.1 to 4 and perused the record.
At the very outset learned counsel for the respondent pointed out that there is provision of appeal under Section 6-C of Essential Commodities Act, 1955 against the order of seizure dated 9.12.2019 passed by the Sub Divisional Magistrate, In view of the above, we are relegating the petitioner to file statutory appeal under Section 6-C of Essential Commodities Act, 1955 before the State Government.
We, however, further provide that in case petitioner prefers an appeal under Section 6-C of Essential Commodities Act, 1955, the same shall be heard and decided by the authority concerned in accordance with law within the period of eight weeks from the date of filing the same.
With the aforesaid observations and directions, this writ petition is finally disposed of and, accordingly, consigned to records.
