Heard the learned counsel for the petitioners and the learned A.G.A. for the State of U.P.
The learned A.G.A. files counter affidavit This petition has been filed by the petitioners with a prayer to quash the F.I.R. in case crime no.450 of 2012 under sections 363,366 I.P.C. P.S. Malihabad district Lucknow.
From the perusal of the F.I.R. it appears that on the basis of the allegations made therein a prima facie offence is made out. There is no ground for interference in the F.I.R. Therefore, the prayer for quashing the impugned F.I.R. is refused.
However, considering the statement of the prosecutrix recorded under section 164 Cr.P.C. on 16.1.2013 by which she has not supported the prosecution story, it is directed that the petitioners shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but the petitioners shall co-operate with the investigation of the case.
With the above direction this petition is finally disposed of.
