This Civil Revision petition is filed to reject the plaint in O.S.No.20 of 2017 on the file of the District Munsif Court, Theni, on the footing that the first respondent / plaintiff had no Cable TV registration certificate for the year 2017.
2.The suit has been laid by the first respondent / plaintiff for permanent injunction. Now, it is the contention of the revision petitioner that the first respondent / plaintiff has not obtained necessary Cable TV registration certificate for the year 2017 and hence, the said suit has to be rejected. However, as regards the said relief, in my considered opinion, the petitioner has to move the concerned Court under Order 7 Rule 11 of Code of Civil Procedure Code. In such view of the matter, I do not feel it necessary to invoke the jurisdiction of this Court under
Article 227 of Constitution of India for rejection of the plaint.
3.Resultantly, this Civil Revision Petition is dismissed. Consequently, the connected miscellaneous petition is closed. No costs.
