Heard learned counsel for the applicant, and learned A.G.A. for the State.
This bail application has been moved by the accused-applicant Om Prakash who is involved in Case Crime No. 1026/2017, under Sections 147, 148, 149, 302 I.P.C., Police Station- Khurja Nagar, District Bulandshahar.
As per prosecution version, on 26.10.2017 at about 10:30 p.m., Padam Singh (deceased) father of informant, was sleeping on cot then applicant with other co-accused Khemchand, Madan, Shankar, Neeraj, Ved Prakash Sharma came there. Co-accused Shankar fired on Padam Singh due to which Padam Singh sustained injury and later on he died.
It is contended by learned counsel for the applicant that the role of applicant is similar to that of co-accused Neeraj and Ved Prakash Sharma, who have been enlarged on bail by this Court vide orders dated 05.02.2018 and 16.02.2018, passed in Criminal Misc. Bail Application Nos. 4216/2018 and 5334/2018, copies of which perused for perusal. Applicant has no criminal antecedent.
Learned A.G.A. has opposed the prayer for bail.
The role of applicant is similar to that of co-accused Neeraj and Ved Prakash Sharma.
Without expressing any opinion on the merits of the case and considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail.
Let the applicant Om Prakash be released on bail in the aforesaid case crime number on furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the Magistrate concerned.
