Heard Shri D.K. Tripathi, learned counsel for the petitioners and Shri Sanjay Kumar Singh, learned Additional Chief Standing Counsel for the respondents.
The petitioners are before this Court with a request to issue direction to the first respondent/Principal Secretary (Revenue), Government of U.P. Lucknow to accord relaxation in their age for regularization of their services as Collection Amin in accordance with the provisions of the U.P. Collection Amins Service Rules 1974.
Learned counsel for the petitioner submits that all the petitioners were engaged as Seasonal Collection Amins prior to the year 2000 in respective Tehsils of District Bijnor. They have worked more than 25 Fasalis and the recovery has been made as per prescribed standard. The petitioners are eligible for regularization on the post of Collection Amin as per Rule 5 of the U.P. Collection Amins Rules, 1974, as amended from time to time. They have crossed the maximum age of 45 years and consequently, the third respondent sent a letter to the first respondent on 09.10.2018 for according relaxation in the age, which is still pending. In support of his submission, he has placed reliance on the judgement of this Court in Devki Nandan and 17 others Vs. State of U.P. and 3 others reported in 2018 (7) ADJ 334 and further Government order dated 22.2.2019, which deals for regularization of Collection Amins. Therefore, he submits that the claim of the petitioner is to be considered in the light of the aforesaid judgement and the Government order dated 22.2.2019.
Learned Additional Chief Standing Counsel submits that the aforesaid issues including the claim of the petitioners for absorption and regularisation shall be duly attended to and disposed of by the respondents in accordance with law and preferably within a period of six weeks from the date of presentation of a copy of this order.
Accordingly and without going into the merits of the claims of the petitioners, this petition shall stand disposed of in light of the statement noted above.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Authority/Official shall verify the authenticity of such computerised copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
