JUDGMENT / ORDER

Court No. - 10
Case :- CONTEMPT APPLICATION (CIVIL) No. - 3633 of 2019 Applicant :- Om Prakash Opposite Party :- Sri Dhananjay Mishra, Additional Civil Judge (S.D.) Counsel for Applicant :- Prashant Kumar Singh,Achal Singh
Hon'ble Mahesh Chandra Tripathi,J.
Heard learned counsel for the applicant.
The petitioner is before this Court for a direction to initiate contempt proceeding against the respondents for disobedience of the order dated 27.2.2018 passed in Matters under Article 227 No.1133 of 2018 filed by the applicant. For ready reference the order dated 27.2.2018 is quoted as under:-
"The instant petition has been filed seeking direction to the executing court to conclude proceedings of execution case no. 11 of 2014 within a specified period.
A supplementary affidavit has been filed, in which it is stated that no objection of any kind has been filed by the judgement debtor in the execution proceedings.
Having regard to the submissions made, the instant petition is disposed of by directing the executing court to make all endeavour to conclude the proceedings of execution case, in accordance with law expeditiously, without granting unnecessary adjournments."
The Court has proceeded to peruse the record in question and finds no reason or occasion calling upon any proceeding under Section 12 of the Contempt of Courts Act, 1971.
The Application is totally misconceived and the same is accordingly dismissed. However, needless to say that the writ court order must be complied with.
