Om Prakash And Another vs Civil Judge (Sr.Dvn.) And 3 Others

High Court Of Judicature at Allahabad|29 July, 2019

JUDGMENT / ORDER

The principal prayer made in the instant petition is for issuing direction to the trial court to decide the application for temporary injunction Paper No.7-C pending in Original Suit No.189 of 2013 within a specified time frame and direct the parties to maintain status quo till disposal of the said application.
A perusal of the order sheet reveals that on 25.1.2019, the Court fixed 28.2.2019 for delivery of exparte orders. It seems that the injunction application was heard on 30.1.2018, but since then, the application has yet not been disposed of finally.
Having regard to the above facts, the instant petition is disposed of with direction to the trial court to make serious endeavour to decide the application expeditiously, preferably within a period of three months from the date of production of a certified copy of this order, provided there is no legal impediment. As regards the prayer made for grant of exparte injunction, the same is declined in view of the fact that exparte injunction was also not granted by the trial court on 16.7.2013 when the application was presented before it. The order refusing to grant exparte injunction by the trial court is not under challenge.
