Petitioners are before this Court assailing the validity of order dated 01.08.2018 passed by the Civil Judge (Senior Division), Hathras in Original Suit no.139/2012 (Om Prakash and others vs. Mohan Singh and others) whereby the Amendment Application of petitioners has been rejected.
The Court has proceeded to peruse the record in question and finds that the order impugned dated 01.08.2018, the petitioner has got efficacious alternate remedy before the Higher Forum but instead of availing the same, the petitioner has directly approached this Court and as such, no relief, as has been asked for, can be accorded to the petitioner under Article 227 of Constitution of India.
Accordingly, the writ petition is dismissed on the ground of alternate remedy.
