The applicant is before this Court for a direction to initiate contempt proceeding against the opposite parties for willful disobedience of the orders dated 13.08.2019 and 04.11.2020 passed in Writ Petition No.26744 of 2019 (Om Prakash Vishwakarma and two others Vs. State of U.P. and Others) and Contempt Application (Civil) No.4240 of 2020 (Om Prakash Vishwakarma Vs. Shri Anil Chaturvedi,S.D.M./S.D.O.).
Today when the mater is taken up, pursuant to the order of this court, Sri. K.R. Singh, learned Additional Chief Standing Counsel filed affidavit of compliance on behalf of opposite party and the same is taken on record.
It is stated in paragraph five of the aforesaid affidavit that in compliance of the order of this court, the restoration application dated 08.03.2018 filed in Appeal No.71/62 (Shyam Dutt Vs. Smt. Sita Devi and others) and Appeal No.70/61 (Brahmdeen and others Vs. Smt. Sita Devi and others) has been decided vide order dated 11.08.2021. It is stated in paragraph 7 of the aforesaid affidavit that the order passed in the writ petition has been fully complied with.
In the circumstances, it is argued by Sri. K.R. Singh, learned Additional Chief Standing Counsel that no further cause of action would further survived and prays for dismissal of the present contempt application.
Heard learned counsel for the parties.
Since the order of the writ court has already been complied with, therefore, no further order is required.
Accordingly, the present contempt application is dismissed.
In case, the applicant is still aggrieved with the decision of the opposite party, he has liberty to challenge the same before appropriate forum.
