Heard Sri Radhey Krishna Pandey, learned counsel for the petitioner, Sri Sant Ram Sharma, learned counsel for the respondent Nos.2, learned Standing Counsel for respondent no.1 and perused the record.
By means of present petition, the petitioner has prayed for disposal of his pending application dated 27.7.2015.
Learned counsel for the petitioner has drawn our attention to the reply received by him under R.T.I Act dated 19.8.2019 in which it is acknowledged that the petitioner's application is pending consideration. He has further drawn our attention towards earlier order of the Nayab Tehsildar by which had rejected the mutation application of his adversary rejecting the claim of alleged will.
Be that as it may, we are of the opinion that the application of the petitioner for mutation be decided by the competent authority on merits in accordance with law after putting to notice all concern and after hearing respective parties who may have interest in the property, preferably within a period of three months from the date of production of certified copy of this order.
Thus the present writ petition stands finally disposed of.
