Learned counsel for the petitioners has placed reliance upon orders dated 19.01.2018 and 29.05.2017 passed in Criminal Misc. Writ Petition No.9562 of 2017 [Reshma Khatoon and 3 Others Vs. State of U.P. And 3 Others] and Criminal Misc. Writ Petition No. 1086 of 2018 [Smt. Jamila Khatoon @ Sajida And 3 Others Vs. State of U.P. And 2 Others] and has submitted that this Court has already granted relief to the said petitioners, who were the actual persons involved in the transaction.
Learned counsel for the petitioners also submits that the petitioners are not even remotely related and have been falsely implicated. In view of the above prima facie case for interim relief is made out.
It is directed that the petitioners shall not be arrested in above mentioned case, till the submission of the police report under Section 173 (2) Cr.P.C. but he shall co-operate with the investigation of the case.
With the aforesaid direction, this Writ Petition is finally
disposed off.
