Heard Sri M.S. Chauhan, learned counsel for the petitioner and learned Standing Counsel for the State respondents.
After some arguments learned counsel for the petitioner very fairly submitted that he is ready to avail the alternative remedy as provided under Clause 13 of Uttar Pradesh Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016 in case the delay in approaching the appellate authority is condoned.
In view of the above, as the writ petition has been filed against the order dated 14.08.2020 passed by the District Supply Officer, Ballia, which is an appealable order, this writ petition is not maintainable. However, it is provided that in case petitioner files statutory appeal under Clause 13 of Uttar Pradesh Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016 within one month from today, the appellate authority shall not go into the question of limitation and shall decide the appeal strictly in accordance with law.
Writ petition is disposed of.
