Heard learned counsel for the petitioner and Sri Vikash Chandra Tripathi, who has accepted notice on behalf of the Railways.
The petitioner by means of this writ petition wants that a direction be issued to the Central Administrative Tribunal, Allahabad to decide original application no. 330/01028 of 2016 within a time bound period.
The submission is that the petitioner is working since 1985. In case, his above original application is not decided with regard to counting of his service rendered during 1985 to 1987 as claimed in the original application, he would suffer irreparable loss and injury.
Since the matter is pending since the year 2016, we dispose off the writ petition with the request to the Tribunal to consider and to fix early date for the purposes of disposal of the above application, if it is ripe for hearing and not to adjourn it on any frivolous or unnecessary ground. In case any adjournment becomes inevitable it should not be granted without imposing a cost not less than Rs.1,000/- per adjournment.
