The prayer in this petition is to direct the State-Respondents to take action against the 5th respondent, who is a private individual, so that he is restrained from interfering in the possession of the petitioner over plot No. 317 and 327 at village Dharmapura, Tehsil-Sadar, District-Mathura.
As the dispute is between two private individuals in respect of property rights, the appropriate course for the petitioner is to institute a suit or take recourse to such civil proceedings, as may be advised.
We, therefore, decline to entertain this petition and leave it open to the petitioner to take recourse to take other appropriate civil remedies.
Subject to above, the petition is dismissed.
