The issue sought to be raised in the instant writ petition is in respect of a Recovery Citation dated 5th February, 2019, issued by the respondent no. 4 / Tehsildar, Tehsil Gola, District Gorakhpur and Recovery Certificate dated 5th December, 2018, issued by the respondent no. 3 / District Excise Officer, Gorakhpur, with regard to recovery of an amount of Rs.5,27,018/-.
In the event, the writ petitioner is able to pay the amount of Rs.5,27,018/-, as demanded in the Recovery Citation dated 5th February, 2019, and Recovery Certificate dated 5th December, 2018, in eight equated monthly instalments, payable on 30th of each successive month, beginning 30th December, 2019, the concerned authority shall not proceed against the writ petitioner. However, in the event of a single default, the protection afforded to the writ petitioner by virtue of this order shall automatically cease and it will be open to the respondent no. 4 or any other competent authority of the State to proceed against the writ petitioner in accordance with law.
The writ petition stands disposed of accordingly.
