The authorised controller of the institution, was appointed on 18.09.2018. The term of the authorised controller, expired on 18.03.2019.
The submission of Sri Ramesh Chandra Dwivedi, learned counsel for the petitioner, is that the respondents have not appointed an authorised controller till date. The affairs of the institution are consequently suffering. Moreover, the elections to the committee of management of the institutions, have also not been held and the new authorised controller may be directed to conduct the aforesaid elections. The petitioner has made an application in this regard before the respondent no. 1.
The respondent no. 1, Principal Secretary, Secondary Education, Government of U.P. Lucknow, is directed to decide the representation of the petitioner for appointment of an authorised controller under Section 16-D(4) of the Intermediate Education Act, and to hold the elections, in the said institution. The order shall be passed within a period of two weeks from the date of receipt of a certified copy of this order along with a fresh copy of representation in that regard.
The writ petition is disposed of.
