Heard learned counsel for the parties.
Learned Standing Counsel has received written instructions from Block Development Officer/Programme Officer, Block Tarawan, District-Azamgarh i.e. fifth respondent.
By the instant writ petition petitioner is assailing the impugned order dated 30.8.2017 whereby recovery has been ordered against the petitioner employed as Technical Assistant on contract basis under MGNREGA scheme.
Learned Standing Counsel submits that a show cause notice shall be served upon petitioner and thereafter it shall be decided expeditiously by the fifth respondent.
Learned counsel for the petitioner has no objection.
In regard thereto, writ petition is disposed of directing fifth respondent i.e. Block Development Officer/Programme Officer, Block Tarawan, District-Azamgarh to issue a notice to the petitioner calling upon him to show cause, to which the petitioner shall submit reply within two weeks thereafter. In the event of the petitioner submits his reply a speaking order thereon shall be passed within four weeks thereafter. The impugned order shall abide by the decision taken by the fifth respondent pursuant to this order. Till the decision is taken by the fifth respondent, the impugned order dated 30.8.2017 shall not be given effect to. A certified copy of this order along with copy of the writ petition shall be served by the petitioner upon fifth respondent within 10 days from today.
