In response to the order dated 10.8.2021, Sri S.A. Murtaza, learned A.G.A. has placed detailed instructions dated 10.8.2021 sent by Sri Hari Narayan Patel, Sub-Inspector of Police, Meerganj, District- Jaunpur and apprised that the petitioner's son, namely, Vivek Kumar Pandey is in judicial custody. In this backdrop, he submits so far as the habeas corpus writ petition, the same is not maintainable in view of law laid down by Full Bench in Km. Rachna and another Vs. State of U.P. and 4 others (Habeas Corpus Writ Petition No. 362 of 2020), decided on 8.3.2021.
In view of the categorical instruction and Full Bench judgement of this Court, present writ petition stands dismissed as not maintainable.
