As per Resolution dated 7.4.2021 of the Committee of this Court for the Purpose of Taking Preventive and Remedial Measures and for Combating the Impending Threat of Covid-19,this case is being heard by way of virtual mode.
Heard Shri Rajiv Lochan Shukla, learned counsel for the applicants; Shri Gaurava, Tripathi, learned counsel for the informant and learned A.G.A for the State through Video Conferencing.
The instant anticipatory bail application has been filed on behalf of the applicants, Om Prakash Modi, Ramesh Chandra Agarwal,Kishan Lal Modi, Rajjan Babu Sarraf, Anant Ram Sarraf and Bhaskar Agarwal with a prayer to release them on bail in Case Crime No. 415 of 2019, under Sections- 420, 467,468,471,120-B I.P.C., Police Station- Mauranipur, District- Jhansi, during pendency of trial.
Learned counsel for the applicants has submitted that applicants have approached this court after submission of charge sheet against them.All the applicants are senior citizens.
Without entering into the merits of the case, learned counsel for the applicants has submitted that in view of second wave of Covid Corona Virus some time may be granted to the applicants to surrender and apply for bail before the court below.
Learned counsel for the informant has submitted that there is no justification for granting any relief to the applicants.No ground is made out for granting anticipatory bail to the applicants.
After considering the rival submissions and this court on the basis of statement of learned counsel for the applicants about his inability to file affidavit in compliance of the order dated 5.4.2021 of this Court on account of closure of physical hearing, the application is disposed of by granting one months time to the applicants to surrender and obtain bail before this court.
However, in view of the entirety of facts and circumstances of the case and on the request of learned counsel for the applicants, it is directed that the applicants will appear and surrender before the court below within 30 days from today and apply for bail.
Till then, no coercive action shall be taken against the applicants.
However, in case, the applicants do not appear before the court below within the aforesaid period, coercive action shall be taken against them.
It is made clear that the applicants will not be granted any further time by this court for surrendering before the court below as directed above.
With the aforesaid directions, this application is finally disposed of.
