Learned counsel for the petitioner contends that the petitioner was using the tractor of his father and, therefore, it cannot be said that offence under Section 406 I.P.C. has been committed, particularly at the instance of a third person.

Issue notice to respondent no.2, returnable on 14.8.2012.

Further proceedings in the case shall remain stayed till the next date of listing.
