Heard learned counsel for the revisionist and the learned A.G.A. for the State.
The instant revision is directed against the order dated 17 April 2019 passed by the Principal Judge, Family Court, Mau in Maintenance Case No. 844 of 2014 (Old No. 1037 of 2013) passed under Section 125 Cr.P.C., Police Station Muhamdabad, District Mau.
The court below has awarded maintenance at Rs.5000/- per month (Rs.3000/- to the wife, opposite party no. 2 and Rs.2000/- to the son, opposite party no. 3) from the date of application i.e. 21 November 2013.
Learned counsel for the revisionist after arguing the matter at length, on instructions, submits that the revisionist undertakes to honour and comply the order of court below, however, in respect of arrears of maintenance, the revisionist seeks liberty to deposit the same in quarterly installment.
Undertaking is recorded and accepted.
The revision is, accordingly, disposed of, on consent, by passing the following orders:
i) the revisionist to comply the order dated 17 April 2019 passed by the court below by depositing the awarded maintenance (Rs.5000/-) on month to month basis as directed commencing 10 July 2019 along with arrears for the months of April and May, 2019;
ii) the arrears with effect from 21 November 2013 till 31 March 2019 to be computed and deposited in equal quarterly installments by 10th of each quarter commencing 1 September 2019, thereafter, in December 2019, March, 2020 and so on.
iii) the monthly maintenance and arrears directed herein above shall be deposited before the court below which shall be released in favour of the opposite party no. 2;
iv) in the event of default, it will be open to the court below to adopt coercive means to recover the sum due in accordance with law.
