This petition is directed against the order dated 28th February 2012, passed by the Commissioner/Secretary Board of Revenue, U.P. Lucknow, whereby petitioner's claim for grant of 3rd Promotional Scheme in the A.C.P scheme has been rejected.
It appears that in respect of his grievance relating to grant of 3rd Promotional Pay Scale, the petitioner had earlier approached this Court by filing Writ Petition No74834 of 2011, which came to be disposed of on 31st December 2011 vide following orders:-
"Grievance of the petitioner is that on 20.8.2011 District Magistrate, Lalitpur has referred the matter to the Commissioner/Secretary Board of Revenue, U.P. Lucknow for considering the matter pertaining to the petitioner in respect of grant of 3rd financial promotion under the scheme of IIIrd Carrier Promotional Benefit, but till date said proceeding has not been finalized.
Consequently, Commissioner/Secretary Board of Revenue, U.P. Lucknow is directed to see and ensure that final decision is taken in accordance with law, preferably within a period of next two months from the date of production of certified copy of this order.
With these observations, writ petition is disposed of."
It is pursuant to the aforesaid order that petitioner's claim has been considered and rejected by the order impugned. The order records that petitioner was appointed on the post of Lekhpal on 22.08.1970 and was promoted to the post of Revenue Inspector on 01.02.1991. He was subsequently promoted to the post of Nayab Tahsildar on 02.02.2007. The order records that as petitioner had not completed 10 years service after grant of 2nd Promotional Pay Scale therefore, the benefit of 3rd Promotional Pay Scale cannot be extended to him.
Learned counsel for the petitioner places reliance upon the Government Order dated 04th may 2010, as per which a Government servant would be entitled to 3 promotions or 3 Promotional Pay Scale upon completion of 26 years of service. It is stated that petitioner had completed more than 26 years of service by the year 2008 and therefore denial of 3rd promotional pay scale to the petitioner when he retired in the year 2009 would be arbitrary.
The entitlement of petitioner to the grant of 3rd Promotional Pay Scale has to be examined in light of the government order dated 4th May 2010. The relevant portion of the Government Order reads as under:-

The Government Order clearly provides that all those who have become entitled to grant of 2nd Promotional Pay Scale upon completion of 24 years service and thereafter completed 26 years of service would be entitled to grant of 3rd Promotional Pay Scale from 1st December 2008. In the facts of the present case the petitioner's initial appointment was made in the year 1970. The period of 26 years therefore had been completed by him prior to 1st of December 2008. His entitlement to receive 2nd Promotional Pay Scale upon completion of 24 years is also not issued to him. It is also not the case of respondents that petitioner was granted 3 promotions in his service tenure. In such circumstances the grant of 3rd Promotional Pay Scale upon completion of 26 years satisfactory service was due and payable to the petitioner with effect from 1st of December 2008. The denial of petitioner's claim, in that regard, vide order dated 28th February 2012 therefore cannot be sustained.
Writ petition succeed and allowed.
Order dated 28 February 2012 stands quashed.
The second respondent shall pass a fresh order in respect of petitioner's claim for release of 3rd Promotional Pay Scale, keeping in view the observation made above, within a period of 3 months from the date of presentation of the certified copy of this order.
All consequential action shall be we taken without further loss of time.
