Having heard the learned advocates for the parties and upon perusing the instant writ petition, it appears that the only issue which falls for consideration is with regard to inaction on the part of the respondent no. 2 / Excise Commissioner, Uttar Pradesh, Mumfordganj, Kushinagar, to decide the statutory appeal, being Excise Appeal No. 60 of 2019 (Om Prakash Jaiswal versus The District Magistrate / Licensing Authority, Kushinagar), till date.
We dispose of the writ petition with a direction upon the respondent no. 2 / Excise Commissioner, Uttar Pradesh, Mumfordganj, Kushinagar, to decide the aforesaid statutory excise appeal as expeditiously as possible, preferably within a period of four weeks, but not later than six weeks from date of communication of a photostat certified copy of this order.
