Heard Sri Ikram Ahmad, learned counsel for the revisionist and Sri Anurag Shukla, holding brief of Sri Devi Shanker Shukla, learned counsel for the opposite parties.
This revision is directed against order dated 9.4.2013 passed by learned Additional District Judge, Court No.10, Varanasi in J.S.C.C. Suit No.69 of 2011 (Om Prakash Jaiswal Versus Assistant General Manager (Niyojan), Office of General Manager, B.S.N.L. Ltd., Shiv Purwa, Varanasi).
Learned counsel for both the parties state that both the parties have settled their dispute and B.T.S. Tower installed on the premises of revisionist has been removed by opposite parties. At this juncture, learned counsel for the parties also referred to annexure no.1 to the affidavit accompanying the compromise application, which is on record.
Sri Shukla, appearing for the opposite parties states that he has no objection if the matter is decided on the basis of compromise. He also states that opposite parties will pay entire due amount i.e. Rs.56,000/- to the revisionist within a period of 15 days from the date of order.
Keeping in view the compromise dated 20.12.2017 arrived at between the parties, as has been disclosed in annexure no.1 to the affidavit accompanying the compromise application, the revision stands disposed of in terms of compromise entered into between the parties. Opposite parties are directed to pay entire due amount within a period of 15 days from the date of order.
The matter stands finally resolved in terms of compromise.
