Called in revised. None appeared to press this revision. In the circumstances, I myself have perused the record.
This criminal revision under Section 397/401 Cr.P.C., has been filed aggrieved by the judgments and orders dated19.8.2006 and 1.4.2003. The Chief Judicial Magistrate Sonebhadra vide order dated 1.4.2003 convicted under Section 323 read with Section 34 of IPC but released the revisionists on probation for a period of one year under the Probation of Offenders Act, 1958, on their person bond of Rs. 10,000/- and surety to the like amount.
Thereagainst, revisionist preferred Criminal Appeal which was filed after prescribed limitation.
The Appellate Court in his order has observed that since the accused-applicants have complied with conviction order and the period of probation has already expired on 13.4.2004 therefore the delay condonation application as well as appeal memo is infructuous at this stage and accordingly dismissed the delay condonation application as well as appeal memo.
Having gone through the record, I do not find any manifest error or otherwise illegality, procedural or otherwise, so as to justify interference in criminal revision.
Dismissed. Interim order, if any, stands vacated. Certify this judgment to the lower Court immediately.
