The submission of learned counsel for the applicant is that according to the allegations in the FIR, it is alleged that accused applicant stood as a witness on a fake application for obtaining the loan of Rs.2,27,700/- from U.P. Cooperative Bank Ltd., Lucknow by forging the documents. It is further submitted that the offences so levelled against the accused applicant are triable by Magistrate. The applicant is in jail since 17.11.2009 and there is no criminal history of the applicant, as averred in paras 10 and 15 of the bail application.
Considering the overall aspects of the matter, I hereby provide that the applicant be released on bail in Case Crime No.631/2005, under Sections 177, 420, 409, 467, 468, 471, 120B IPC & 13 (1) (d) red with section 13 (2) PC Act, 1988, P.S. Hazratganj, District Lucknow, on his filing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned.
