Heard learned counsel for the applicant and the learned AGA.
The applicant has been summoned under Section 340 Cr.P.C. and the appeal preferred by him against the order of the Magistrate has been rejected.
I have perused the impugned order as well as the material brought on record by the applicant. There is no justification for interfering the impugned orders. However, it will be open to the applicant to raise all the objections which have been raised by him before this Court in the instant application before the concerned Magistrate and in case such objections are raised by the applicant, the same shall be considered and decided by the Magistrate concerned/Court concerned in accordance with law.
Subject to the aforesaid direction, this application finally disposed of.
