Heard Shri Vinod Kumar Singh, learned counsel for the petitioner; learned Additional Chief Standing Counsel for the State respondent nos. 1 and 2 and Shri Shivam Yadav, learned counsel for the respondent no.3.
The present writ petition has been filed for following principal reliefs:-
"(i) issue a writ, order or direction in the nature of certiorari to quash the order dated 25.5.2016 passed by District Basic Education Officer, Meerut as well as corrected order dated 31.5.2016 passed by District Basic Education Officer, Meerut (Annexure No.4 to the writ petition) (ii) issue a writ, order or direction in the nature of mandamus commanding the District Inspector of Schools, Meerut to examine the claim of petitioner for grant of session benefit as well as consequential benefits like arrears of salary w.e.f. 1.7.2015 to 31.3.2016 and pass appropriate order within the period stipulated by this Hon'ble Court."
At the very outset, learned counsel for the petitioner states that the petitioner would not like to press the first relief and so far as the second relief is concerned, the same is liable to be decided in terms of the judgment and order of this Court dated 12.12.2017 passed in Writ A No.33360 of 2017 (Angad Yadav and 7 others vs. State of U.P. and 4 others).
With the consent of parties, the writ petition is disposed of asking the District Inspector of Schools, Meerut to decide the claim set up by the petitioner in the light of the judgment rendered in Writ A No.33360 of 2017 (Angad Yadav and 7 others vs. State of U.P. and 4 others) within a period of six weeks from the date of receipt of certified copy of this order.
