Gandhi Shatabdi Smarak Bapu Inter College, District Meerut, is a recognized Intermediate Institution but payment of salary is being released to the teachers and other employees under the Uttar Pradesh Recognized Basic Schools (Junior High Schools) (Recruitment and Conditions of Service of Teachers) Rules, 1978.
It appears that petitioner has approached this Court with the grievance that petitioner is entitled to sessions benefit and a direction was issued by this Court on 27th March, 2018 in Writ Petition No.8622 of 2018 for the District Inspector of Schools to examine this aspect. The authority concerned has already sanctioned the sessions benefit to petitioner. Grievance of the petitioner is that since payment of salary is to be released by the District Basic Education Officer, the District Basic Education Officer has not taken steps in compliance with the directions issued by the District Inspector of Schools on 25th June, 2018. Aggrieved by inaction on part of the authority concerned, petitioner is before this Court.
Sri Shivam Yadav appearing for the respondent no.3 submits that grievance of petitioner shall be examined, in accordance with law.
In the facts and circumstances, noticed above, this writ petition stands disposed of permitting the petitioner to approach respondent no.3, in respect of his grievance annexing all relevant materials in support of his claim, alongwith certified copy of this order, within two weeks from today. In case such a claim is raised, the same shall be examined by the authority concerned, in accordance with law, by passing an appropriate order, within a further period of two months, thereafter.
