Sri A.R. Dube is present on behalf of the appellant and Sri Aditya Bhushan Singhal has filed his vakalatnama today on behalf of respondent/Zila Panchayat Bulandshahar, which is taken on record.
A preliminary objection has been raised by learned counsel for the respondent with regard to maintainability of this second appeal by submitting that no second appeal is maintainable against an order passed by the Appellate Officer u/s 9 of the U.P. Public Premises (Eviction of Unauthorized Occupants) Act, 1972.
At this stage, learned counsel for the appellant prayed that he may be permitted to withdraw this appeal.
As prayed by learned counsel for the appellant, the appeal is dismissed as withdrawn with liberty to the appellant to seek any other relief permissible in law, if so advised.
The certified copy of the impugned judgement and decree be returned back to learned counsel for the appellant after retaining its photocopy on the record.
