JUDGMENT / ORDER

Petition filed under Section 438 Cr.P.C. 2. Petitioner is the accused in Crime No.924 of 2014 of Nileshwaram Police Station, registered for the offences punishable under Section 55(a) of the Abkari Act.
3. The allegation against the petitioner is that on 11.11.2014, he was found transporting 24 bottles, each containing 500 ml of Indian Made Foreign Liquor, by his autorickshaw bearing registration No.KL-14-F-1361. When the autorickshaw was stopped during a vehicle check, the petitioner ran way from the autorickshaw just after giving his name to the police.
4. Heard learned counsel for the petitioner and the learned Public Prosecutor.
5. This is an application seeking anticipatory bail in an Abkari case, which cannot be entertained normally. There is BA No.8459/2014 : 2 :
no compelling circumstances to invoke the provisions under Section 438 Cr.P.C. in this case. The allegations against the petitioner are very grave and serious. Considering all the above, I am of the view that he is not entitled to the discretionary relief of anticipatory bail.
In the result, this bail application is dismissed.
