JUDGMENT / ORDER

After having heard the learned counsel for the petitioner and the learned counsel for the respondent, it is felt that a detailed order is not necessary. It is only appropriate that the impugned order is set aside and the matter is sent back to the lower court since the parties so desire. 2. This petition is allowed and the impugned order Ext.P3 is set aside. The lower court is directed to take up the matter and send it for mediation so as to enable the parties to arrive at a settlement and thereafter pass fresh orders in the light of the mediation settlement. The parties will appear before the lower court on 05.11.2014.
Registry to send a copy of the judgment to the lower court immediately.
