1. The applicant is a under trial prisoner in connection with I CR No. 2 of 2012 for the offences punishable under sections 167, 406, 420, 465, 466, 467, 471, 474, 120B and 114 of IPC and 34 of IPC.
2. This is an application for extension of temporary bail for a period of 30 days on account of surgery to be performed on the wife of the applicant.
3. Heard learned advocate Ms. Krishna Mishra for the applicant and learned Additional Public Prosecutor Mr. Nanavati for the respondent who after getting the certificate verified stated that the operation is postponed on 25th July 2012.

Considering the fact that earlier the applicant wife could not undergo surgery due to her very poor health condition and as the applicant-accused was also required to donate the blood, for the very said purpose of surgery this application is being allowed. However, it is being clarified that in the event of surgery not being performed; as scheduled, the applicant shall surrender immediately.
4. On consideration of the submissions made by the learned advocate for the applicant and learned Additional Public Prosecutor, this Application is allowed. The applicant-accused is allowed extension of temporary bail for a period of 7 days commencing from 21st July 2012, on his furnishing a personal bond of Rs 10,000/- (rupees ten thousand only) with one surety of like amount to the satisfaction of the jail authorities and on conditions that;
(a) during the period of his temporary bail, he shall maintain law and order and shall not take disadvantage of his liberty;
[b] upon completion of the period of his temporary bail, he shall immediately surrender to the concerned jail authority; without fail..
5. Rule is made absolute in the above terms. Direct service is permitted today.
