Mr. Vyas, Ld. Advocate for Mr. Mehta, Ld. Advocate for the applicant - appellant submits that pursuant to the order dated 30/11/2011 passed in this matter, the decree amount has been deposited with the trial Court. In that view of the matter, this application for stay stands disposed of and ad-interim stay earlier granted vide para. 5[i] of this application is confirmed till final disposal of the appeal, reserving the liberty of the respondent to apply for withdrawal of the amount.
In the meanwhile, the decretal amount deposited by the applicant - appellant before the trial Court shall be invested in the FDR in any nationalized bank, initially for the period of three years, which period shall be extended till final disposal of the appeal. The amount of interest to be accrued on the FDR shall be invested in the FDR itself. The order be communicated to the concerned trial Court immediately.
