In spite of notice having been served upon them, respondent Nos.2 to 5 have not appeared before the Court. Considering the prayer made in the application, the said respondents may have something to say. In order to avoid complications at a later stage, it would be in the interest of justice to issue fresh notices to the said respondents.
The Registry is, therefore, directed to issue fresh notices to respondent nos.2 to 5, making it returnable on 27.6.2012.
Mr.
L.R. Pathan, learned advocate for Mr. Mohd. Hanif Shaikh, learned counsel for respondent No.1, submits that the said respondents have filed an affidavit dated 28th April, 2012 stating that, upon inquiry being made, the present value of the properties situated at Ankleshwar, GIDC and the premium rate that is going on at present is Rs.1,300/- per sq. mtr.

Dr. Amee Yajnik, learned advocate for the petitioner (Official Liquidator) submits that the affidavit does not contain any basis for the statement made and does not disclose on what ground the rate of Rs.1,300/- per sq. mtr. has been stated.
Let respondent No.1- Bank file a further detailed affidavit disclosing the basis for the statement made in the present affidavit that the present premium rate for properties situated in Ankleshwar Industrial Estate is Rs.1,300/- per sq. mtr.
