The petitioners are the plaintiffs in O.S.No.10 of 2014 on the file of the Wakf Tribunal, Kozhikode. The respondents are the defendants therein. In this original petition filed on 9.4.2014 the petitioners inter alia seek an order directing the Wakf Tribunal, Kozhikode to pass appropriate orders on I.A.No.60 of 2014 in O.S.No.10 of 2014 within a time limit to be fixed by this Court.

When the original petition came up for hearing today, Sri.R.Ramdas, learned counsel appearing for the petitioners submitted that the original petition was filed for the reason that the Wakf Tribunal, Kozhikode was not hearing and disposing of cases in view of the amendment to the Wakf Act, 1995, till this Court in Ali Akbar v. Abdul Azeez Mannisseri (2014 (3) KLT 307) held that amendment to the Wakf Act, 1995 does not prevent the Wakf Tribunals in existence from hearing and disposing of cases and therefore, the original petition may be disposed of with a direction to the Wakf Tribunal to take up I.A.No.60 of 2014 in O.S.No.10 of 2014 for consideration and pass appropriate orders thereon expeditiously.
O.P.(Wakf) No.19/2014 2 In the light of the aforesaid submission, we dispose of the original petition with a direction to the Wakf Tribunal, Kozhikode to take up I.A.No.60 of 2014 in O.S.No.10 of 2014 and pass appropriate orders thereon in accordance with law expeditiously and in any event within one month from the date on which the petitioners produce a copy of this judgment before the Wakf Tribunal. If the defendants in the suit have not filed their objections to I.A.No.60 of 2014 in O.S.No.10 of 2014, the same shall be filed within two weeks from the date of receipt of a copy of this judgment.
