JUDGMENT / ORDER

1. Mr.R.M.
Desai, learned counsel appearing for the Official Liquidator seeks permission to delete unserved respondent Nos.10 and 11. Permission is granted. Mr.R.M. Desai, learned counsel appearing for the Official Liquidator is permitted to delete unserved respondent Nos.10 and 11 accordingly.
2. Mr.R.M.
Desai, learned counsel states that even though prayer is made for deletion of the original prayer 9(a) in Official Liquidator Report No.206 of 2008, instead of deleting the said paragraph, the applicant be permitted to add, what is sought to be substituted by prayer 5(a) in this application.
3. Heard Mr.Desai, learned counsel for the Official Liquidator, Ms.Nita Pandit, learned counsel for Mr.A.R. Gupta for respondent No.1, Ms.Sejal Bhatt, learned counsel for M/s.Trivedi & Gupta for respondent No.15 and Mr.Rajesh Mankad, learned counsel for respondent No.14. The other respondents, though served, none appears on their behalf.

Considering the averments made in the present Official Liquidator Report and as there is no objection to grant of addition of prayer, as prayed for and as stated by Mr.Desai, learned counsel for the Official Liquidator, as above, permission, as sought for, is granted. The applicant is permitted to amend the prayer clause of the Official Liquidator Report and add prayer, as prayed for, in paragraph No.5(a) of the present Official Liquidator Report.
5. Hence, the applicant is permitted to carry out necessary amendment in Official Liquidator Report No.206 of 2008 latest by 26.03.2012. It would be open for the parties to file appropriate reply to the said amended prayer.
6. Ms.Pandit, learned counsel submits that as directed earlier by this Court, the authorised person of respondent No.1 is present in the Court and is identified by learned counsel Ms.Pandit.
