ORDER:
This Writ Petition is filed for a Mandamus to declare the action of the respondents, in finalizing and affirming the final answer key published on 08.03.2014 without deleting Question Nos.94 and 96 (in Question Set No.C) of MDSET 2014, as illegal and arbitrary.
At the hearing, it is not disputed that Writ Petition No.8996 of 2014 filed by seven similarly placed students was dismissed by a learned single Judge of this Court on 29.04.2014. The Review Petition filed seeking review of the said order was also dismissed on 09.07.2014 with a direction to respondent No.1-University to refer the key answers along with objections to seven questions raised to the Professors/Head of the Departments of concerned subjects in any of Government Dental Colleges at Hyderabad or Vijayawada and basing on the opinion obtained from the Professors/Head of the Departments, the respondents may award marks in respect of the said questions and then proceed with the counselling.
It is stated in the counter-affidavit filed on behalf of respondent Nos.1 and 2 that in pursuance of the said direction, the questions were referred to the experts who have their given opinion, as per which marks were awarded.
It has come out at the hearing that the answers given by the petitioner are not in conformity with the opinion of the experts. It is also stated at the Bar that the last date for admissions has expired and the academic year has already been commenced.
In the above facts, no relief can be granted to the petitioner.
The Writ Petition is, accordingly, dismissed.
As a sequel, W.P.M.P.No.29243 of 2014 is dismissed as infructuous.
