The petitioner has undertaken a contract (Improvements to Vlathankara-Avanakkinvila Road - Ch 0/00 to 2/950 Kms with chipping carpet) in Trivandrum District. The work could not be completed within the time due to communal violence. The work was stopped for more than six months. On account of this, extension of time was granted. The work was ultimately discontinued.
2. The petitioner submitted that certain portion of the work has been completed by him. The petitioner further submits that the rate fixed for the work was taking note of the prevalent rate at the time of the award of the work and on account of reasons beyond his control, he has incurred more expenses for executing the work which he has completed. He further submitted that he is entitled for an enhanced rate of work. The petitioner raised his grievances before the first respondent by way of Exts.P20 and P21. The only request made by the petitioner before this Court is early disposal of Exts.P20 and P21 by the first respondent.

3. In view of the above, there shall be a direction to the first respondent to consider Exts.P20 and P21 and take an appropriate decision after affording an opportunity of hearing to the petitioner within a period of six weeks.
The writ petition is disposed of as above.
