This Writ Petition is filed for a Mandamus to set aside proceeding No.CS5/7979/2014, dated 01-10-2014, of respondent No.2, whereby he has suspended the petitioner’s license for distribution of Kerosene meant for Public Distribution by virtue of the powers vested under Clause 28 (2) of the Andhra Pradesh Petroleum Products (Licensing and Regulation of Supplies) Order, 1980.
Mr.N.Siva Reddy, learned Counsel for the petitioner, made a futile attempt to convince this Court that the impugned order of respondent No.2 suspending the petitioner’s license without initiating enquiry is not sustainable. However, having realized the fact that such a contention was conclusively repelled by this Court in Sri Venkateswara Gas Agencies, Sirvel Village & Mandal, Kurnool District vs. Government of A.P., the learned Counsel requested for a direction to respondent No.2 to complete the enquiry and pass a final order at an early date.
In the light of the above request, the Writ Petition is disposed of without interfering with the order of suspension and with the direction to respondent No.2 to complete the enquiry and pass a final order within three months from the date of receipt of this order.
As a sequel, WPMP.No.37863 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
