A.M.Shaffique, J This writ petition is filed seeking police protection for fixing the boundary stones in the property of the petitioner and that of the fifth respondent. 2. By an interim order dated 4.9.2013, directions were issued by this court to permit the petitioner to approach the Taluk Surveyor for fixing the spot to put the survey stones.
3. Learned counsel for the fifth respondent submits that they have dispute with regard to fixing of boundaries and pendency of the writ petition or the interim directions issued should not preclude them from approaching the Civil Court for appropriate relief.
4. Since the purpose of the writ petition is already over, there is no reason to continue the interim order as such. However, we make it clear that the directions issued by this Court for police protection and restoration of boundary stone fixed WP(C).No.11569/13 2 by the Taluk Surveyor shall not preclude the petitioner from approaching the Civil Court to raise dispute regarding measurement.
With this observation,the writ petition is closed.
