JUDGMENT / ORDER

Heard the learned counsel appearing for the petitioner and the learned counsels appearing for the respondents.

This writ petition has been filed praying for a Writ of Mandamus to direct the fourth and fifth respondents to issue the `Nativity Certificate' and consequently, to direct the second respondent to accept the application of the petitioner's son (TNEA-2009 vide Application No.210408) for the purpose of admission in the Engineering Colleges.

The petitioner has stated that the petitioner's son (S.Shyam Sundar) had written the Higher Secondary Examinations in the month of March, 2009 and he had secured 1066 out of 1200, with an overall percentage of 88.83%. Thereafter, he had applied for admission in the Engineering Colleges, vide Application No.210408. However, the said application had not been considered by the second respondent, since the certificate produced by the candidate was not in the proper form. Therefore, the present writ petition had been filed on behalf of the petitioner, praying for the reliefs, as stated therein.

The learned counsel appearing for the petitioner had submitted that the fourth respondent had failed to consider Clauses 4 and 5 of the Certificate No.I, which forms part of the prospectus, issued by the second respondent, while issuing the `Nativity Certificate', as requested by the petitioner. In fact, the fourth respondent had issued a certificate striking out the word `nativity' and adding the word `residence', while issuing the certificate requested for by the petitioner.
5. It has also been submitted that the petitioner had submitted the necessary records before the fourth respondent to prove his nativity. However, the fourth respondent had erred in issuing only the `Certificate of Residence' instead of issuing the `Certificate of Nativity' showing that the petitioner is a native of the State of Tamilnadu.

This Court by an order, dated 1.7.2009, had directed the petitioner to submit all the necessary documents before the fourth respondent and on such submission, the fourth respondent had been directed to consider the request of the petitioner by issuing the nativity certificate, as per Certificate No.I, forming part of the prospectus issued by the second respondent for the Tamil Nadu Engineering Admissions. Pursuant to the said order, the fourth respondent had issued a `Nativity Certificate', dated 8.7.2009.

In the above mentioned circumstances, the second respondent is directed to consider the request of the petitioner to accept the `Nativity Certificate' and to issue the call letter to the petitioner, based on the marks obtained by the petitioner in the Higher Secondary Examinations, held in the month of March, 2009, for admission in the Engineering Colleges. The writ petition is disposed of accordingly. No costs. Consequently, connected M.P.No.1 of 2009 is closed.
