JUDGMENT / ORDER

The petitioner, along with the mother and daughter, claims to be the owner of the property in Sy.Nos.50/1 & 51/3 of the Vallachira Village. The petitioner, as per Ext.P4 order, was granted permission by the 2nd respondent-Revenue Divisional Officer to remove ordinary sand. The petitioner approached the Geologist for issuance of P Form. The Geologist rejected the petitioner's request stating that the petitioner seeks to extract ordinary earth and, therefore, environmental clearance is necessary. It is challenging the above order, the writ petition is filed. 2. Ext.P4 makes it clear the purpose, for which the permission is granted to the petitioner, and therefore,it does not require environmental clearance. Therefore, P Form can be issued on condition that the petitioner shall remove ordinary sand as per the terms in Ext.P4. In order to safeguard, I am of W.P.(c).No. 28726 of 2014 : 2 :
the view that this shall be done on supervision of the Local Level Monitory Committee or the Agricultural Officer.
Therefore, there shall be a direction to the 1st respondent- Geologist to issue necessary P Form based on Ext.P4 only to the extent of permitted activities in Ext.P4. The petitioner shall be permitted to remove the ordinary sand based on Ext.P4 on the supervision of the Local Level Monitoring Committee or Agricultural Officer. The Revenue Officials shall ensure that the petitioner is complied with Ext.P4 in its intent and purport.
The writ petition is disposed of as above.
