N.Shanmugham vs Dr.Girija Vaidyanathan

Madras High Court|10 January, 2017

JUDGMENT / ORDER

(Order of the Court was made by The Hon'ble Chief Justice) In terms of order dated 19.11.2015, it was recorded that the appeals are pending which were stated to be the impediment in taking action to enforce the order of the Tahsildar dated 22.08.2011. The appeals, we are informed, were dismissed on 04.02.2016. We, thus, called upon the learned Special Government Pleader to inform us on instructions from the Revenue Divisional Officer and Tahsildar present as to what action they have taken to enforce their own orders. There is no answer other than saying that they have joined couple of months back.
2.It is a matter of great regret that authorities are unable to enforce their own orders and sleeping over the matter giving specious excuses. Eleven months have passed since the appellate authority affirmed the order and we are not informed that there is any other impediment in enforcement of the order.
3.We direct the District Collector, Tiruvallur District, to hold an enquiry and fix responsibility on the officer responsible for not implementing the orders and thereafter, to proceed departmentally against the delinquent officer.
4.In so far as the implementation now is concerned, we are assured that necessary steps will be taken within one (1) month from today.
Contempt petition is, accordingly, disposed of.
