N.Selvarajan vs The Sub-Registrar

Madras High Court|21 October, 2009

JUDGMENT / ORDER

This Writ Petition has been filed for issuance of a Writ of Mandamus to direct the first respondent to cancel the document No.2517 of 2009, executed by the second respondent in favour of the third respondent, registered on the file of the first respondent.
2. Mr.K.Balasubramanian, learned Additional Government Pleader takes notice on behalf of the first respondent and with the consent of both parties, the writ Petition itself is taken up for final disposal.
3. Even though the prayer in the Writ Petition is for a larger relief, learned counsel for the petitioner had submitted that it would suffice, if the representation of the petitioner, dated 19.09.2009, submitted to the first respondent, is directed to be disposed of, on merits and in accordance with law, within a specified period fixed by this Court.
4. The learned Additional Government Pleader appearing for the first respondent has no objection for such an order being passed by this Court.
5. In view of the submissions made by the learned counsel appearing for the petitioner, as well as the learned Additional Government Pleader appearing for the first respondent, the first respondent is directed to dispose of the representation of the petitioner, dated 19.09.2009, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order, after giving a reasonable opportunity of hearing to the second and the third respondents herein. However, it is made clear, that this Court, by this order, has not expressed any opinion on the merits of the matter. The Petitioner is directed to furnish a copy of the representation, dated 19.09.2009, to the first respondent, along with a copy of this order.
6. With the above direction, the Writ Petition is disposed of. Consequently, connected Miscellaneous Petition is closed. No costs.
