JUDGMENT / ORDER

The grievance of the petitioner seems to be that in view of the subsequent petition filed by the petitioner, it will not be proper for the court below to proceed with the suit. It is further pointed out that pointing out all the facts, the petitioner has moved a petition before the lower court to remove the case from the list. Unfortunately for the petitioner, that petition is posted to the very same day on which the suit is listed for trial. The petitioner apprehends that the petition will be dismissed and the trial will commence, which, according to him, is prejudicial to him in the light of what is stated in the petition. Therefore, it is prayed that there may be a direction to the court below to remove the case from the list and thereafter defer the trial for some time.
O.P.(C). 2671/2014. 2 This Original Petition is disposed of with a direction to the Munsiff's Court, Perumbavoor to take up I.A.2582 of 2014 in O.S. 129 of 2012, the petition for removing the suit from the list, and dispose of the I.A. in accordance with law as expeditiously as possible. Trial of the suit shall stand deferred for a period of three weeks from today.
